First Month Update
It’s been a while since we’ve updated this site, but that’s not owing to lack of movement in the case. In the wake of Heller, we’ve all been extraordinarily busy. But it is our intent to provide more timely updates and discussion of this important case going forward. We do get many inquiries about the status of the case, and wish to prevent the sort of misinformation that inevitably develops in odd corners of the Internet when news runs low. So, here’s an update recapping the first month of McDonald v. City of Chicago.
The day after we filed the lawsuit, the court issued an order redacting certain aspects of the complaint and suggesting that we show cause as to why Mayor Daley should remain a defendant. Such orders may be uncommon elsewhere but they are a part of the way this court functions. The court’s redactions of the complaint do not appear to substantively impact the nature of the dispute, but we did feel compelled to respond to the court’s order with respect to Mayor Daley. The court declined to revisit its earlier order and stated that Mayor Daley remains dismissed from the action. A minute order expressly dismissing Mayor Daley from the lawsuit followed.
The city timely answered our complaint. This case will now move forward.
